Effective October 16, 2026
Terms of Service
These Terms govern Bookmarqer, operated by Latent Ape LLC, a Tennessee limited liability company (“Latent Ape,” “we,” “us”). “Service” includes bookmarqer.com, the Chrome extension, iOS app/share extension, API, and related functionality. By creating an account or using the Service after being given notice of these Terms, you agree to them. If you do not agree, do not use the Service. These Terms do not replace the separate permission required for AI sharing.
1. Eligibility and accounts
You must be at least 13 years old to create an account or use the Service. If you have not reached the age of legal majority where you live, you must have permission from a parent or legal guardian to use the Service and agree to these Terms. You must have authority to act for any organization you represent. Following other users and viewing public social feeds require you to be at least 18. Personal bookmarking does not require an age check during signup. Bookmarqer does not offer accounts for children under 13, including with informal parental permission. Provide accurate account information, protect your credentials, and notify us of suspected unauthorized use at support@latentape.com. You are responsible for activity you authorize and recipients/integrations you connect.
2. The service
Bookmarqer helps save and organize links and create AI-assisted summaries, categories, and content profiles. Retrieval can fail, and a public link does not guarantee access. We may impose disclosed usage limits, modify features, or suspend access to address abuse, legal obligations, or material security risks. Where practical and lawful, we will give notice and an opportunity to retrieve your content before discontinuing the Service.
3. Your content and permissions
You retain rights you hold in your submissions. You grant Latent Ape a nonexclusive license to store, reproduce, retrieve, process, and transmit that content as necessary to operate the features you request, including through the disclosed service providers. This license does not transfer ownership. You must have the rights and permissions needed to submit content and third-party personal data. Saving a link does not give you rights to republish its source.
4. Acceptable use
Do not use the Service unlawfully, infringe others’ rights, distribute malicious content, attempt unauthorized access, evade access restrictions or usage limits, or interfere with other users. Do not submit credentials, payment-card data, regulated health records, or other sensitive information for which the Service and its contracts have not been approved. Do not use automated scores to make consequential decisions about people.
Public submissions are reviewed before publication. Do not publish sexual exploitation, explicit sexual content, threats, hateful or harassing material, illegal content, or spam. We may withhold or remove public content and restrict public participation for violations. Use Report / block to flag concerns or block a user; contact support@latentape.com to appeal a moderation decision.
5. AI and third-party services
Summaries, suggested categories, and scores may be inaccurate, incomplete, outdated, or misleading. Review original sources and verify material claims. Outputs are not professional medical, financial, or legal advice. Source sites, X embeds, authentication services, and AI/email providers may have their own terms. The Privacy Policy describes data flows; AI processing requires your explicit permission in the AI sharing settings. You may refuse or withdraw that permission and continue saving and manually organizing content.
6. Sharing and email
You may choose a public username and publish individual projects. Publishing shares project names and all current and future saved link titles, URLs and save dates, including automatically assigned links. Only publish information you have permission to share. Public pages may be copied or indexed by others; unpublishing cannot recall those copies. You can make projects or your profile private in Settings. Followers receive access only to currently public content.
A library is account-scoped, but a project email recipient or authorized integration can receive information you direct us to share. Configure recipients carefully and ensure they expect those communications. Turning off account digests does not remove separately configured project recipients. No email service guarantees inbox placement.
7. Fees and app-store terms
Pricing, any trial, renewal, cancellation, and refund terms must be disclosed before you purchase a paid offering. This document does not create a subscription or authorize charges. Applicable Apple and Google store terms also apply. For an App Store version, Apple’s standard licensed-application EULA applies unless a compliant custom EULA is supplied; these Terms govern the associated hosted service without overriding mandatory store or consumer protections.
8. Suspension, termination and data
You may stop using the Service and request account deletion inside iOS, through web settings, or with help at support@latentape.com, as described on our account deletion page. We may suspend or terminate access for a material violation, abuse, or legal requirement. Provisions that by their nature survive termination continue, subject to applicable law. Retention and deletion are described in the Privacy Policy; neither uninstalling the app nor deleting a project deletes all account data.
9. Warranties and liability
To the extent permitted by law, the Service is provided “as is” and “as available,” without warranties of uninterrupted operation, fitness for a particular purpose, or accuracy of generated content. Nothing excludes a nonwaivable consumer right, liability for fraud or intentional misconduct, or other liability that cannot lawfully be limited. These Terms do not impose a monetary liability cap or exclude remedies that applicable law provides.
10. Governing law and disputes
Tennessee law governs to the extent permitted by applicable law, without depriving consumers of mandatory protections in their home jurisdiction. No arbitration agreement or class-action waiver is created here. Courts with jurisdiction may hear disputes. For support, email support@latentape.com. Written notices may be sent to Latent Ape LLC, 937 Glendale, Nashville, TN 37204, United States.
11. Changes and contact
We will give appropriate notice of material changes and request renewed acceptance where required. Contact Latent Ape LLC at support@latentape.com; additional business details appear at Legal & trust. The Privacy Policy and any separately executed DPA apply according to their respective scope.
